Sample question · Singapore Legal System
Parliament passes an Act, after the commencement of the Constitution, one section of which is inconsistent with a fundamental liberty guaranteed by Part 4 of the Constitution of the Republic of Singapore.
What is the effect of that section?
C is correct. Article 4 provides that the Constitution is the supreme law of the Republic, and that any law enacted by the Legislature after its commencement which is inconsistent with it is, to the extent of the inconsistency, void.
A and B are wrong because Singapore has constitutional supremacy, not parliamentary sovereignty.
D is wrong because only the inconsistent part is void, not the whole Act.
Sample question · Dispute Resolution Practice
Order 3 of the Rules of Court 2021 sets out the Ideals that the Rules seek to achieve.
Which of the following is NOT one of those Ideals?
D is correct because it is not an Ideal. The Rules of Court 2021, in force from 1 April 2022, list the Ideals as fair access to justice, expeditious proceedings, cost-effective work proportionate to the nature, importance and complexity of the claim, efficient use of court resources, and fair and practical results suited to the needs of the parties.
The Rules aim to reduce, not increase, interlocutory applications. The court and the parties must seek to achieve the Ideals in all cases.
