Sample question

Sample question · Contracts

On March 1, a flour supplier mailed a letter to a bakery offering to sell it 500 pounds of flour at $0.40 per pound. The letter did not say how long the offer would stay open or how it had to be accepted. On March 3, the bakery mailed a properly addressed and stamped letter accepting the offer. On March 4, before the acceptance arrived, the supplier telephoned the bakery and said that it was revoking the offer. The acceptance reached the supplier on March 5.

Is there a contract between the supplier and the bakery?

  1. A No, because the revocation was communicated before the acceptance was received.
  2. B No, because an offer that does not state a period for acceptance can be revoked at any time before the acceptance is received.
  3. C Yes, a contract was formed on March 3, when the bakery mailed its acceptance.
  4. D Yes, a contract was formed on March 5, when the supplier received the acceptance.
Show the answer

C is correct. Under the mailbox rule, an acceptance sent by a reasonable means is effective when it is dispatched, while a revocation is effective only when the offeree receives it. The offer came by mail, so mail was a reasonable way to accept. The contract was formed on March 3, before the March 4 revocation.

A and B are wrong because the offer was still open when the acceptance was mailed, and a revocation that arrives after dispatch of the acceptance comes too late.

D is wrong because the acceptance took effect on dispatch, not on receipt. The same result follows for a sale of goods under the UCC, which allows acceptance by any medium reasonable in the circumstances.

Questions

Frequently asked questions

What is on the New York bar exam?

Until February 2028 New York uses the Uniform Bar Examination: the Multistate Bar Examination (MBE), the Multistate Essay Examination (MEE) and the Multistate Performance Test (MPT). Candidates must also complete the New York Law Course and pass the New York Law Exam. From July 2028 New York moves to the NextGen bar exam.

How many questions are on the MBE?

The MBE has 200 multiple-choice questions split across two three-hour sessions, so you have about 1.8 minutes for each question. Our practice sets use the same pace.

Can foreign lawyers take the New York bar exam?

Many foreign-educated lawyers and LLM graduates are eligible, but each candidate must have their legal education evaluated by the New York State Board of Law Examiners first. Check your eligibility with the Board before you register.

Are these real MBE questions?

No. Our questions are written by Law Assessment in the MBE style and explain every option. Official retired questions are sold by the National Conference of Bar Examiners.
