Sample question · Contracts
Aurelie Bergstrom grows apples in the Silver Valley. Northfold Cider Co. makes cider at its plant in the town of Pell Creek and stores fruit at a warehouse in Halbrook. Assume that no statute requires any contract in this question to be in writing.
1 June: Ms. Bergstrom emailed Northfold: "I can supply 40 tonnes of Honeycrisp apples for delivery in September at $900 per tonne, delivered to your Halbrook warehouse. This offer stays open until 15 June."
5 June: Northfold's buyer, Mateus Grieve, replied by email: "We accept, provided you deliver to our Pell Creek plant instead of Halbrook."
8 June: Ms. Bergstrom's neighbour, who also sells to Northfold and whom Mr. Grieve knows well, told Mr. Grieve that Ms. Bergstrom had "already sold most of her Honeycrisp crop to a supermarket chain".
9 June: Mr. Grieve emailed Ms. Bergstrom: "Forget the Pell Creek request. We accept your offer of 1 June exactly as written."
10 June: Ms. Bergstrom telephoned Mr. Grieve. She said: "The supermarket deal fell through. I still have 40 tonnes. Same terms as my email of 1 June, if you want them." Mr. Grieve replied: "Done."
In July a hailstorm damaged part of Ms. Bergstrom's orchard. To fill Northfold's order she would have to hand-sort the fruit and buy some apples from other growers, which would cost her about $180 a tonne more than she had expected. On 20 July she wrote to Northfold: "I cannot deliver at $900. I need $1,100 a tonne, or I will sell what I have to other buyers who are offering more." Northfold had already sold its autumn cider production to a restaurant chain, and no other grower could supply that quantity of Honeycrisp in time. On 22 July Mr. Grieve emailed: "We have no choice. We agree to $1,100 a tonne." Ms. Bergstrom did not ask for, and Northfold did not receive, anything else in return.
On 1 August Northfold's chief executive, Hollis Pryce, emailed Ms. Bergstrom: "Don't worry about the September date. With the hail, if you need to, deliver by 15 October and we won't hold you to September." Relying on this, Ms. Bergstrom spent September hand-sorting her own fruit instead of buying apples from other growers, and delivered all 40 tonnes on 10 October.
Northfold paid $900 a tonne. It refuses to pay the extra $200 a tonne. It also says it will deduct $15,000 for losses caused by late delivery. Ms. Bergstrom sues for the balance. Assume that the Court of Appeal of the Province has not yet decided whether to follow Gilbert Steel Ltd. v. University Construction Ltd. or NAV Canada v. Greater Fredericton Airport Authority Inc.

Questions
They are the challenge exams set by the National Committee on Accreditation of the Federation of Law Societies of Canada. Lawyers and law graduates trained outside Canada pass the subjects the NCA assigns them before they can enter a Canadian law society's licensing process.
Yes. Each exam lasts 3 hours and you may use hard-copy materials, including annotated and tabbed notes. Electronic materials are not allowed, and answers are typed on a locked-down platform.
The exams are graded pass or fail, and 50% is a pass. Marks come from spotting the issues, stating the rule with authority and applying it to the facts.
Each mock follows the structure of the current exam for that subject. You write your answers in the browser against a 3-hour clock, then compare them with a full answer plan and marking guide. With tutoring, your tutor can mark them.
The NCA announced in October 2026 a modernized framework of five exams and three courses, phased in from early 2027 with full implementation in 2028. Applicants with an existing assessment can usually keep to their report. Our mocks follow the current subject exams.
